Terms of Use

Effective date: September 22, 2026

These Terms of Use ("Terms") govern your use of www.tnshconsulting.com (the "Site") and any purchase made through it from True North Safety & Health LLC, doing business as True North Safety & Health Consulting ("True North," "we," "us"). By using the Site or buying a service, you agree to these Terms. If you don't agree, don't use the Site.

1. Site content is general information only

Content on the Site, including articles, checklists, service descriptions, and references to OSHA standards, is general information for educational purposes. It is not professional safety, engineering, medical, or legal advice for your specific situation. Regulations and interpretations change, and applying them depends on site-specific facts. Don't rely on Site content in place of a professional assessment of your workplace.

2. No client relationship until a written agreement

Using the Site, submitting a form, or emailing or calling us does not create a consulting or client relationship. A relationship begins only when both parties sign a written services agreement, proposal, or statement of work (an "Agreement"), or when you complete a purchase through the Site. If an Agreement conflicts with these Terms, the Agreement controls.

3. Your responsibilities as employer and worksite controller

You, and not True North, remain responsible for complying with the Occupational Safety and Health Act, 29 CFR 1910 and 1926, state-plan requirements, and all other laws that apply to your operations. Unless a signed Agreement expressly states otherwise:

  • True North acts as an advisor and does not create, control, or correct hazards at your worksite.

  • True North does not supervise, direct, or control your employees or subcontractors, and does not have authority to stop work or to change means and methods.

  • True North does not assume your duty to provide a safe workplace, or any duty owed by you or any other employer on the project.

  • You decide whether and how to implement any recommendation, and you are responsible for the results of those decisions.

  • Observations and reports reflect conditions seen at a point in time. They are not a guarantee that all hazards or violations were identified.

4. No guarantee of results

True North does not guarantee any outcome, including the absence of injuries or incidents, passing an inspection, avoiding citations or penalties, reducing or withdrawing citations, or a particular result at an informal conference or contest proceeding. Past results do not predict future outcomes.

5. Citation and regulatory support is not legal representation

True North is not a law firm and does not practice law. Citation response, informal conference support, and appeal-strategy services are technical safety consulting. For legal advice or representation before any agency, commission, or court, retain a licensed attorney. We are happy to work alongside your counsel.

6. Training

OSHA Outreach Training courses are delivered under the OSHA Outreach Training Program and its requirements, including attendance, time, and class-size rules. Course completion cards are issued only to students who meet those requirements. Completing training does not by itself make a person "competent" or "qualified" for a task under OSHA standards. The employer is responsible for those determinations.

7. Purchases, payment, cancellation, and refunds

Prices on the Site are in U.S. dollars and may change without notice. "From" prices are starting points; final pricing depends on scope, location, class size, and travel. Payment is processed by third-party providers under their own terms. Unless an Agreement says otherwise: you may cancel a scheduled service for a full refund more than 21 business days before the scheduled date; receive a 50% refund if you cancel 11 to 21 business days before the scheduled date; and receive no refund if you cancel 10 or fewer business days before the scheduled date or after service delivery has begun. Travel expenses already incurred are not refundable. We may reschedule because of weather, site access, or safety conditions, and rescheduling is not grounds for a refund.

8. Intellectual property

The Site and its content, including text, graphics, logos, and templates, belong to True North or its licensors and are protected by copyright and trademark law. You may view and print Site content for your own internal, non-commercial use. You may not copy, resell, or redistribute it without our written permission. Deliverables provided under an Agreement are licensed as that Agreement states.

9. Acceptable use

You agree not to misuse the Site. That includes submitting false information, attempting unauthorized access, interfering with its operation, scraping it for commercial purposes, or using it for any unlawful purpose.

10. Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, TRUE NORTH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. Services are warranted only as stated in a signed Agreement.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW: (A) TRUE NORTH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, PROJECT DELAYS, FINES, OR PENALTIES, EVEN IF ADVISED OF THEIR POSSIBILITY; AND (B) TRUE NORTH'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR ANY SERVICE WILL NOT EXCEED THE FEES YOU PAID TRUE NORTH FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. These limits apply to all theories of liability, including contract, tort, negligence, and strict liability.

12. Indemnification

You agree to defend, indemnify, and hold harmless True North and its owner, employees, and contractors from any claims, damages, penalties, losses, and expenses, including reasonable attorneys' fees, arising from: (a) conditions at your worksite; (b) acts or omissions of you, your employees, or your subcontractors; (c) your decision whether to implement our recommendations; (d) your violation of any law; or (e) your breach of these Terms.

13. Governing law, disputes, and time limit

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Before filing any claim, the parties will try in good faith to resolve the dispute informally for at least 30 days after written notice. Any lawsuit must be brought only in the state or federal courts located in Lubbock County, Texas, and both parties consent to that jurisdiction. Claims must be brought individually and not as a plaintiff or class member in any class or representative action. Any claim arising out of the Site or services must be filed within one (1) year after it arises, or it is permanently barred, to the extent the law permits.

14. General

If any provision of these Terms is found unenforceable, the rest remain in effect and that provision will be enforced to the maximum extent permitted. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. Sections 3, 4, 5, and 8 through 13 survive any end of your use of the Site or of any engagement. We may update these Terms by posting a revised version with a new effective date.
